La Fundació guifi.net presenta les seves propostes per a l'avantprojecte de Llei General de Telecomunicacions

The Spanish government opened a process of hearing and public information on the preliminary draft, and objections could be submitted until October 13

On September 8, 2020, the Spanish government published on the Ministry of Economic Affairs and Digital Transformation website the General Telecommunications Bill Preliminary Draft, initiating the process of consultation and public information through which the proposed regulations affecting rights and legitimate interests of individuals are made available to affected citizens, entities, and social groups for suggestions, improvements, and allegations.

The guifi.net Foundation, as an entity working for a telecommunications model based on a shared infrastructure of commons, open, free, and neutral to enable the deployment of high-speed electronic communications networks throughout the territory at a fair price, has submitted our allegations through the established procedure, in which we request:

  1. Declare as common good or public domain the public telecommunications networks in a regime of provision to third parties that public administrations deploy.

  2. Promote the obligation to interconnect internet exchange points (IXPs) of operators and the exchange of all independent autonomous systems closest, and at a fair price.

  3. Ensure the right to information and transparency on available telecommunications infrastructures financed with public resources.

  4. Guarantee the operators' access right and information and transparency in telecommunications infrastructures where, even if promoted by private operators, there is a financial contribution from public administrations, whether through a subsidy or any other form of financing.

  5. Urge the modification of administrative deadlines provided for in RD 330/2016 for the resolution of disputes concerning access to infrastructures capable of hosting high-speed electronic communications networks, as they are excessive and contrary to the purpose of the European legislator when Directive 2014/61/EU aimed to streamline and reduce the costs of deploying these networks.

We consider our proposals as minimum requirements to promote a telecommunications market that encourages connectivity to reach all households as a basic service. Where water and electricity reach, it is possible for fiber optics to reach, and the goal of governments should be to ensure it reaches at a fair price, with a clear public service vocation. We will closely monitor the approval of the bill to demand the inclusion of the proposed measures in parliamentary sessions.
